Now now, lady—don’t mislead. It was a vehicle-owner DUI, which is a different misdemeanor than a regular DUI. I wasn’t drinking and driving, as your headline implies.

Having once been arrested for a DWI (back before they lowered the legal limit to .08), I have to say I am very happy for you that your offense is a misdemeanor. DUIs and DWIs are expensive and embarrassing, and I’m glad you aren’t losing your license or anything. That is one fucked up law.

No you’re right Brittney, the penalties are the same, but it is listed differently on your arrest record, because there is a critical distinction between actually being the one driving and being the one aiding an intoxicated person by letting them drive your car. (Same thing happened to quarterback Steve McNair, actually.) I think in some cases people who knowingly hand their car keys to a total drunk who could go on to do untold damage ought to be held accountable. But in a situation like mine, it seemed we were every bit the exception to the rule–both of us had clean records, no prior arrests and he was right at the legal limit. We were stopped a roadblock for going 36 in a 30. I think that ought to have been a case where police discretion was employed and we were let go. My case was dismissed because the driver got a reduced charge, but not without me spending a night in jail and paying a couple grand for a lawyer. Total waste of resources all around. Thanks for correcting the headline.
